Chapter 173-566 WAC

On June 25, 2019, Ecology adopted a new rule: Chapter 173-566 WAC – Streamflow Restoration Funding for funding projects under Chapter 90.94 RCW.
In its 2018 session, the Washington Legislature directed Ecology to restore and enhance stream flows. In addition to fees collected from applicants for building permits where development would rely on permit-exempt wells, the Legislature authorized $300 million in capital funds over the next 15 years to:
  • Implement watershed restoration and enhancement projects developed under RCW 90.94.020 and RCW 90.94.030.
  • Collect data and complete studies necessary to develop, implement, and evaluate watershed restoration and enhancement projects under Chapter 1, Laws of 2018, codified in Chapter 90.94 RCW, statewide.
The Streamflow Restoration Funding Rule establishes process and criteria for prioritizing and approving grants consistent with legislative intent, thus making Ecology’s funding decisions and contracting more transparent, consistent, and defensible.
