On Jan. 14, 2019, we approved the Kittitas County Shoreline Master Program (SMP) amendment. Under state law, the effective date of Kittitas County's SMP is Jan. 28, 2019, 14 days after we provided notice to the County that their SMP was approved.
Need for amendment
On Feb. 22, 2016, we approved the county's comprehensive SMP update. Subsequently, the Yakama Nation petitioned the Growth Management Hearings Board for review of the SMP, challenging the adequacy of the SMP's provisions dealing with cultural, historical, and archeological resources.
Kittitas County, Ecology, and the Yakama Nation engaged in a series of settlement negotiations and developed an SMP amendment that addresses the respective concerns of all parties and that meets or exceeds the requirement of the Shoreline Management Act. The proposed amendment was included in a May 3, 2018, settlement agreement.
Amendment history and review process
Notice of a joint local-state review process was provided on Jun. 8, 2018 and Aug. 3, 2018. The county provided notice to local parties. We distributed notice of the joint comment period to state interested parties on Jun. 7, 2018.
A joint public hearing was conducted before the Kittitas County Planning Commission on Aug. 28, 2018. The 30-day public comment period closed Sept. 4, 2018. The Planning Commission recommended approval of the SMP amendment with one minor revision. No written public comments were received during the comment period.
On Oct. 1, 2018, Kittitas county staff submitted the proposed SMP amendments to us.. We prepared an initial determination that the amendment is consistent with the state Shoreline Management Act and applicable guidelines. On Oct. 3, 2018, We issued a written statement of initial concurrence for the SMP amendment.
Notice of the Board of County Commissioners public hearing was published in the Daily Record on Oct. 18, 2018 and Oct. 25, 2018. The Kittitas County Board of County Commissioners held a public hearing on Nov. 20, 2018, to hear public testimony on the proposed SMP amendment. After deliberation, County Commissioners approved Resolution 2018-195 ordering the county's Development Services Director to submit the SMP to us for final approval.
