On April 20, 2022, we approved the Towns of Rockford, Waverly, and Latah (Rockford Coalition) Shoreline Master Program (SMP) comprehensive update and periodic review. Per RCW 90.58.090, the effective date of Coalitions SMP is May 4, 2022, 14 days after we provided notice to the coalitions that their SMP was approved.
In the past, all three jurisdictions have implemented Spokane County’s 1975 SMP, however they never performed any shoreline permitting themselves. The comprehensive update and periodic review amendment introduces the Coalitions shared goals, policies, regulations, shoreline environment designations, and administrative procedures and definitions, and is locally-tailored to reflect current conditions and community vision for future shoreline use and development.
The SMP applies along approximately 1.25 miles of shoreline along Rock Creek, while Latah and Waverly have a combine shoreline of approximately 1.5 miles along Hangman (Latah). The updated SMP prioritizes water-oriented activities, public access, habitat protection, and ecological restoration, and allows for legal existing uses and structures to continue. The periodic review amendments are based on recent changes to statute and rule, and address minor issues regarding the substantial development cost threshold, ADA retrofit permit exemption, definitions, local review and permit filing procedures, nonconforming use and development, and transportation project review. Both the comprehensive update and periodic review are mandated by RCW 90.58.080.
The Coalition provided multiple opportunities to engage in the process to ensure all residents had a meaningful chance to participate. The Coalition published a legal notice in the Spokane Valley News Herald on April 10, 2015, during the 2015 comprehensive update and again on June 11, 2021, during the 2021 periodic review. No comments were received during the first comment period in 2015. A single commenter requested information about lists of native species for shoreline replanting during the most recent June 16, 2021 local process public hearing.
Notice of the state comment period was distributed to state and Coalition identified interested parties. The state comment period began on November 24, 2021 and continued through December 27, 2021. A separate invitation to comment and consult Government to Government, as necessary, was provided to the Coeur d’Alene Tribe, Spokane Tribe, and the Colville Tribe on November 18, 2021. No comments were submitted on the proposed Coalition SMP.
