On April 19, 2019, we approved a locally-initiated amendment to Whatcom County's Shoreline Master Program (SMP). Per RCW 90.58.090, the effective date of Whatcom County's SMP is May 3, 2019, 14 days after we provided notice to the county that their SMP amendment was approved.
The amendment is limited to the incorporation of recently adopted changes to Whatcom County's Critical Areas Ordinance (CAO) into its SMP. The changes would make the SMP consistent with the CAO, subject to the existing exception outlined in the current SMP.
Public comment period
We held a public comment period from March 12 through April 11, 2018. Mail and email were used to notify interested parties of the public comment period. We received comments from one individual and one from an organization/group. Comments focused on issues related to how select CAO provisions would be applied, and questions related to whether recent CAO changes would affect existing agricultural uses in SMP jurisdiction.
One May 31, 2018, we sent a summary of comments to the county for their response. The public comments, along with the county's and our responses have been included as Attachment B: Responsiveness Summary.

- Per RCW 90.58.190(2) and RCW 36.70A.290, an interested party may file and appeal with the Growth Management Hearings Board within 60 days of the publication date of our written notice of final action.
- We plan to publish the notice of final action in the Bellingham Herald legal ads on May 3, 2019.
