Port Orchard Limited Amendment

On February 15, 2018, we approved the City of Port Orchard’s Amendment to their Shoreline Master Program (SMP). Per RCW 90.58.090, the effective date of the City of Port Orchard’s SMP amendment is March 1, 2018, 14 days after Ecology provided notice to the city that their shoreline program was approved.

The city’s limited amendment proposes several changes to their existing shoreline program. The changes include clarifications to nonconforming uses and provisions for structures, specifically addressing redevelopment in the built-out High Intensity Shoreline Environmental Designations, and general clarifications and corrections related to SMP implementation.

A public comment period was held from January 3 through February 2, 2017. Mail and email were used to notify interested parties of the public comment period. We received one written comment from the Washington State Department of Natural Resources. The public comment and the city’s response have been incorporated into Attachment A: Findings and Conclusions (below).

On January 24, 2018, we provided the City of Port Orchard with required changes to the proposed amendment to its Shoreline Master Program. The changes are based on our review of whether or not the proposed update complies with state laws and rules. On February 3, 2018, the city notified us of their acceptance of the revisions requested and its intention to adopt these changes. On February 20, 2018, the city notified us of the adoption of Ordinance 006-18, adopting the SMP amendment revisions that were requested in Ecology’s conditional approval letter.

Appeals

  • Per RCW 90.58.190(2) and RCW 36.70A.290, an interested party may file an appeal with the Growth Management Hearings Board within 60 days of the publication date of our written notice of final action.
  • Ecology plans to publish the notice of final action in the Kitsap Sun legal ads on March 26, 2018.
