Tentative Public Meeting and Hearing: Model Toxics Control Act (MTCA) Agreed Order, Public Participation Plan, and Demolition Interim Action Work Plan

We have scheduled a tentative virtual public hearing via Zoom to accept oral comments on the proposed Agreed Order, Public Participation Plan and Demolition Interim Action Work Plan for the Intalco Aluminum site.
Registration is required for this event. After registering, you will receive a confirmation email containing information about joining the hearing. Register online. The public hearing will be held if Ecology received significant public interest. Ecology will notify interested parties prior to cancelling the tentative public hearing if we have not received significant interest by April 6, 2026.
Background
The proposed Order requires Intalco Aluminum LLC and Petrogas Pacific LLC to develop a Remedial Investigation Work Plan, conduct a Remedial Investigation, implement a Demolition Interim Action Work Plan, conduct other interim actions if required or agreed to by Ecology, develop a Remedial Investigation/Feasibility Study Report, and develop a Draft Cleanup Action Plan to select cleanup alternatives.
The proposed Public Participation Plan describes ways Ecology will inform the public about contamination investigations and cleanup options throughout the cleanup process. Ecology encourages the public to learn about and get involved in decision-making opportunities. This plan identifies how and when the public can get involved during different stages of the investigation and cleanup of contamination.
The proposed Demolition Interim Action Work Plan provides a plan for cleanup activities that may occur during the demolition and removal of the old smelter infrastructure (buildings, pipes, storage tanks, etc). The plan specifies how contaminated soil will be identified during demolition and how the contaminated soil will be removed to reduce potential threats to human health and the environment prior to the remedial investigation and feasibility study in the Order.
Why it matters
This is an opportunity to have your voice heard and influence the decision-making process. You know about your neighborhood, community and local conditions and how Ecology’s regulatory proposal may affect them. Although Ecology is bound by existing state and federal laws, your comments can influence how solutions are achieved.
Industrial practices and historical land use by the smelter owners and operators have resulted in contamination at the site. Over the years, there have been documented releases and spills. Contamination at the site has not been fully investigated. Liable parties are to conduct remedial work which will provide additional information on the location and types of contaminants at the site and develop a path towards cleaning up the site.
