Block 38 West cleanup site, Seattle

We invite you to comment on an environmental study of this site and comparison of cleanup options, a draft cleanup action plan, and a legal agreement.

Ecology is overseeing the cleanup of the Block 38 West Site in Seattle’s South Lake Union neighborhood. City Investors IX L.L.C. is the Potentially Liable Person cleaning up the site. ​ Historical operations and placement of contaminated fill at the Block 38 West Property contaminated soil and groundwater at the site.

From October 2019 through July 2021, City Investors IX did substantial early cleanup work as part of redeveloping the site. Workers removed contaminated soil from the Block 38 West Property and neighboring alley and disposed of it off-site. Cleanup work done before a full cleanup action plan is called an ‘interim action,’ and may be done before the site is fully studied.

In this case, the environmental study of the site showed that the interim action work cleaned up enough contamination that the site meets the requirements of the state cleanup law, the Model Toxics Control Act. The only remaining need is to implement institutional controls.

We invite you to comment on the following documents:

  • Remedial Investigation and Focused Feasibility Study (Volume 1 and Volume 2): describes the results of environmental studies detailing contamination at the site, and evaluates and recommends a preferred cleanup action.
  • Draft Cleanup Action Plan: describes the cleanup work done and institutional controls needed to protect the site in the future.
  • Consent Decree: a legal agreement between Ecology and City Investors IX, that requires City Investors IX to implement the cleanup action plan.
