Safer Products for Washington manufacturer orders for information
As part of Safer Products for Washington, we have the authority to issue manufacturer orders for information (manufacturer orders) (RCW 70A.350.030(4) and 70A.350.040(2)). Manufacturer orders are one way that our team learns about chemicals and how they are used in products. They provide information for us to consider when determining appropriate regulatory actions. They require producers or distributors of products offered for sale in Washington to supply information about specific products.
Manufacturer orders do not mean that a manufacturer is out of compliance with existing product restrictions or reporting requirements.
Manufacturer order process
When we issue a manufacturer order, we may ask the manufacturer to provide the following or other information (RCW 70A.350.040(2)(a)):
- A list of products containing priority chemicals.
- Product ingredients.
- Information about exposure and chemical hazards.
- A description of the amount and function of the priority chemical in the product.
After a manufacturer order is issued, manufacturers have six months to submit the required information. During this time, we check in with the selected manufacturers to answer questions, provide information about the order’s requirements, and offer support.
Once manufacturers submit their information to us, we review the data, ask follow-up questions, or request additional information as needed. We consider the information provided as we research feasibility and availability of potential safer alternatives to priority chemicals in products.
Current and completed manufacturer orders
Below, we’ve listed manufacturer orders and published summaries by chemical-product combination based on the year the order was issued.
Though not required by law, we aim to develop summary reports after a manufacturer order is complete. These reports provide data on chemical-product combinations showing where and how chemicals are used. This information also promotes transparency in program efforts to reduce priority chemicals in consumer products.
Confidentiality Requests
Manufacturers can apply for confidential treatment of information if they have concerns about sharing information about their products sold in Washington. To grant information confidential status, manufacturers must show that the information provided is legitimately unique to their company or is worthy of protection due to real potential for competitive harm from disclosure to the public or competitors.
