Winery general permit

Washington is the second-largest wine-producing state in the nation. If not properly managed, process wastewater from wineries can potentially harm groundwater resources and damage wastewater treatment and storage equipment. Ecology first issued the Winery General Permit in 2019 to help protect groundwater in Washington and prevent process wastewater from overwhelming wastewater treatment plants.

Washington's Winery General Permit regulates discharges of process wastewater from wineries to land, groundwater, and wastewater treatment plants. No surface water discharges are allowed under this permit. This permit is for large wineries that meet a permitting threshold. The threshold is based on wine production volume, and wastewater discharge methods.

The Winery General Permit does not cover wine spills or solid waste from wine production. Report wine spills to Ecology using the Statewide Environmental Reports Tracking System (ERTS).

The current permit went into effect July 1, 2024, and expires June 30, 2029.

Permit reissuance

The current permit expires in 2029, but we are starting our process early to update the permit because we are considering expanding the permit to other alcoholic beverage facilities such as large breweries, cideries, and distilleries.  

Some alcoholic beverage facilities are already covered under individual State Waste Discharge permits. Our research and experience indicates that wastewater discharges from alcoholic beverage manufacturing facilities can be similar to those from wineries. So because they have similar potential pollution, we are considering expanding this permit to include large alcoholic beverage facilities that produce more than 17,835 gallons or 7500 cases per year, that discharges their wastewater to ground. This permit would not apply to a facility that discharges to a wastewater treatment facility. By moving to a general permit it is usually simpler and less costly for both permittees and Ecology because it streamlines permit coverage and administration. We have not finalized any expansion plans yet.

We are seeking early input to better understand concerns, potential impacts, and opportunities for improvement. We are holding the first of many opportunities for feedback with an early listening session (see more information below) and accepting feedback until July 31, 2026.

Public involvement

We encourage wineries, breweries, cideries, distilleries, other alcoholic beverage manufacturers, and anyone else interested to share feedback with us. We are hoping to hear from you and discuss your feedback and suggestions for other changes you would like to see in the draft permit. We will consider the feedback collected during this period as we draft the next version of the permit, however, we will not provide formal responses to input we receive.

Next steps

After gathering preliminary feedback, we plan to draft an updated permit in spring 2028. When we have the draft permit we will issue a public notice and ask for formal comments on the draft. During this period, we will host at least one public meeting and hearing where spoken comments and accept written comments. After the formal comment period, we consider and respond to all comments received. We use this input to refine the permit before finalizing the new version. 

Anticipated permit reissuance timeline

  • Through summer 2026: Gather preliminary feedback on the current permit
  • Fall 2026: Decide on developing permit expansion for draft permit
  • Spring 2028: Formal comment period on the draft permit and public hearing(s)
  • Spring 2029: Decision on reissuance
  • June 30, 2029: Current permit expires
