We invite you to attend our next public listening session to share information and provide feedback on our proposed rule to establish a new formal permitting program for projects that could alter or impact wetlands, streams and other state waters.

The November listening session will include a brief overview of the state’s new rulemaking process focusing on an outline of the rule’s proposed scope and goals. We are also considering projects and activities that could potentially be exempt from needing a permit under this new rule including: 

  • Projects that receive Section 401 Water Quality Certification addressing all impacted waters at a project site.
  • Projects covered under a Class I, II or III Forest Practices permit.
  • Some existing and ongoing agricultural activities.
  • Maintenance activities involving some public facilities and structures. 
  • Constructing temporary sedimentation basins. 
  • Activities covered by a State Waste Discharge permit or cleanup actions under the Model Toxics Control Act. 
  • Emergency repair and response activities.
  • Stormwater systems regulated by a National Pollutant Discharge Elimination System permit.
