Draft Prospective Purchaser Consent Decree

JYK Holdings, LLC intends to purchase, clean up, and redevelop properties associated with this site.

The TOC Facility No. 01 176 cleanup site has three parcels; two associated with this purchase (the property) and an adjacent parcel owned by someone else. These properties are located in Mountlake Terrace, on 56th Ave. W near 242nd Street SW.

We invite you to review and comment on the following documents, available on the TOC Facility No. 01 176 cleanup webpage:

  • The Prospective Purchaser Consent Decree is a legal agreement that directs the Prospective Purchaser to implement an Ecology-approved cleanup action for the site once they have completed the purchase. 
  • The Remedial Investigation/Feasibility Study describes the contamination at the site, evaluates cleanup action alternatives, and selects a preferred alternative.
  • The Cleanup Action Plan describes the selected cleanup action, which includes:
    • Fixing and expanding the existing multi-phase extraction remediation system on the site.
    • Operating that system for three years to treat remaining groundwater contamination.
    • Collecting soil and groundwater performance and confirmation samples.
    • Capping or covering residual contaminated soil at the site, if necessary.
    • Implementing institutional controls under an environmental covenant, if necessary.
    • Providing engineered vapor intrusion mitigation at the site, if necessary.
  • The Public Participation Plan describes how Ecology will inform the community about site activities and ways to become involved.
