Safer Products for Washington compliance and reporting

The Safer Products Restrictions and Reporting Rule (Chapter 173-337 WAC) was adopted in 2023 and implements our Safer Products for Washington (SPWA) program. This rule applies to priority consumer products manufactured, distributed, sold, or offered for sale within or into Washington that contain a priority chemical. This includes products sold for residential or commercial use, and those sold online by direct-to-consumer retailers shipping directly to purchasers in Washington state.

What products are currently restricted? 

The following priority chemicals and products are restricted as of the dates listed below.

Restrictions on products are based on the date of manufacture. The rule makes allowances for existing stock as well as repair and replacement parts, depending on their manufacture date.

What are the reporting requirements?

Manufacturers must submit reports to Ecology if they use intentionally added priority chemicals in the following priority consumer products (see table below). As of the effective date of the reporting requirements, manufacturers must identify and track these products. Reports are due by Jan. 31 of the year after the effective date, and every year thereafter by Jan. 31.

How to submit reports

Submit your report through the High Priority Chemical Data System (HPCDS). This system is released and maintained by Interstate Chemical Clearinghouse (IC2). IC2 provides user guides to assist with reporting and data searches. First-time users need to create an account by registering on HPCDS before submitting information.

Who is responsible for submitting your report?

The manufacturer of the priority consumer product, or a trade organization representing the manufacturer, may serve as the reporting party. Manufacturers must ensure that only one report is submitted for a priority consumer product. The rule includes a hierarchy to determine who Ecology will hold responsible for meeting the reporting requirements.
